How to nicely kick BIL out? long :( update on page 7!

Ok I've posted before about my BIL in the different group and was sent here. A little back story. He moved in with us at the end of August in our one bedroom apartment. The original deal was that we were to help him save up for first months rent and a deposit on his own place and he would move out. Well almost three months later and he is still "saving" up. I have to admit i probably didn't help things by doing everything for him like cooking, cleaning, and washing. And my DH didn't charge him to stay here, just said to help out with groceries. In three months he gave us 250$ overall. He doesn't respect my house, keeps his space dirty, almost has sex with his gf on our couch, leaves doors open at night (we leave in not "so safe" area), comes home at 2 in the mornings and knocks on the door waking everyone up. Im just sick of him! Im due in 4 weeks and I just feel like its time for him to go. My DH talk to him in the beginning of November and BIL said he will move out once the baby is here. Well he is not saving up at all so i know he won't. I really need him to move out in the beginning of December, so it will give time to deep clean the house before the baby arrives. And i also would like to set up my Xmas tree too, but his shit is all over the living room. My DH doesn't want to be an ass so what is the nice way to kick him out?! BIL knows i dont want him here anymore, because I've made it clear, but he won't leave until his brother tells him too. Ughh please help me, im so uncomfortable here. And im planning on breastfeeding my LO and I've told everyone so. I dont get along with MIL but thats another story.. And BIL doesn't want to go live back with her because she charges too much, and just an unpleasant person to stay with. Thank you and have a good day!! Sorry for such long post.
